Paper III — CENTRE STATE RELATIONS

Answer any FIVE questions.
All questions carry equal marks.
1. Explain how the Federal features of the Canadian Constitution and the Government of India Act, 1935 influenced the Union and state relations under the Constitution of India.
2. Explain the powers and functions of Federal Court under the Indian Constitution.
3. “Freedom of Trade and Commerce in India shall free” Mention the circumstances in which reasonable restrictions can be imposed over the above freedom.
4. What is meant by basic structure doctrine? Explain how it is interpreted by the Supreme Court in deciding amending power of the Parliament of India.
5. What is the procedure required under the constitution for imposition of National Emergency? Also mention the effect of national emergency.
6. Explain provisions under the Indian Constitution for establishment of Cooperative Federalism.
7. Who is civil a servant? What are the safeguards available to the civil servants against their ‘dismissal’, ‘removal’ or ‘reduction’ in rank?
8. Explain the difference between Parliamentary form of government and Presidential form of government. Do you suggest Presidential form of government to India?
9. Explain the privileges and immunities available to the members of the legislatures inIndia. Also explain the decision of opinion of Supreme Court in Keshayv Singh’s in this regard.
10. Write short notes on any TWO of the following:
(a) Financial emergency. (b) Residuary powers.
(c) Governor under the Constitution. (d) Coalition Government.
