Paper III – LAW OF CRIMES
Time : Three hours Maximum : 100 marks
Answer any FIVE questions.
All questions carry equal marks.
1. The intent and the act must both concur to constitute the crime. Explain how far the said statement is valid in modern times.
2. What is ‘Abetment’? If a person abets an act and a different act is committed amounting to an offence. What is the liability of such person as an abettor?
3. Define Murder. Distinguish it from culpable homicide not amounting to murder.
4. ‘‘No one is born criminal’’ – Explain and what is the approach of the reformative theory of punishment.
5. Define Attempt. When attempt is punishable and distinguish between preparation and attempt to commit a crime.
6. Examine the scope of the defence of ‘Intoxication’ with the help of decided cases.
7. Examine the essentials of the offence of Robbery and distinguish between Thift and
Dacoity.
8. What are the ingredients of an ‘Unlawful assembly’? Under what circumstances a
person becomes liable as a member of an ‘unlawful assembly’ and for an offence of
‘Rioling’?
9. The Jurisdiction of the criminal courts is territorial as well as extraterritorial. Explain.
10. Write note on any TWO of the following :
(a) Criminal Conspiracy
(b) Common intention
(c) Mistake of fact
(d) ‘Defamation’.
