Paper VII — LAW OF NEGLIGENCE AND DAMAGES
Time : Three hours Maximum : 100 marks
Answer any FIVE questions.
All questions carry equal marks.
1. With the help of case law. Distinguish between reasonable foreseability and remote possibility.
2. Explain the prevalent theories relating to assessment of the value of dependency.
3. How far contributory negligence is a defence for actions on liability for negligence?
4. Illustrate with case law the concept of ‘course of employment’ as a prerequisite for fixing vicarious liability.
5. Critically analyse the use and importance of the doctrine of res ipsa loquitur as a rule-of proof.
6. Critically examine the judicial dictum in Donoghue Vs Stevenson to explain the concept of ‘neighbour’.
7. Explain the important aspects of insurer’s liability under the motor vehicles Act, 1939 and the relevant changes brought under its later amendments.
8. Discuss the merits and demerits of bringing medical negligence within the purview of consumer protection Act.
9. Narrate the different types of damages along with the justification for such distinction.
10. Write short note on any TWO.
